عام

1. private-yacht.com من Deep Blue Co., Ltd (يشار إليها فيما بعد بـ Deep Blue)، رقم TAT 34/03030، تقدم على الموقع الإلكتروني private-yacht.com جولات بالقوارب في تايلاند وتنظم جولات بالقوارب.
2. بتأجير قارب أو شراء جولة، فإنك توافق على شروطنا والأحكام المحددة أدناه.

 

الإيجار الخاص

1. The boat rental including all costs for meals and additional add-ons must be paid in full before the start of the cruise. المدفوعات are accepted in cash, by bank transfer, or credit card.
2. إيجار القوارب من Deep Blue يشمل دائماً الوقود والكابتن والطاقم المرخصين ومعدات السلامة والإسعافات الأولية وتأمين الحوادث.
3. Furthermore the boat rental يشمل all the services mentioned on the website or during the booking process (only writen agreements count). Often more, but never less. If certain services offered are not used voluntarily or if services are expected that go beyond the agreed service, no claim for reimbursement can be derived من this. This also applies to self-inflicted delays or tour cancellations due to rule-breaking behavior.
4. Waiting time is always paid time: If the customer do not start the trip on time and do not arrange this with us separately, the lost tour time is non-refundable. An extension of the tour beyond the previously fixed time is possible only by further agreement and probably additional surcharge. Please keep in mind, that most boats can't cruise after sunset. In case of reduced tour time the captain may decide to change the planned itinerary depending on the delay.
5. Due to their tight schedules taxis that we have ordered for the transfer usually wait a maximum of 15 minutes. If they need to cancel the transfer order, they will nevertheless charge the full amount and the customer will need to arrange another transport on your own.

التنفيذ

1. تحتفظ Deep Blue بالحق في تغيير المسارات ومواقع الالتقاء والإنزال إذا اقتضت ظروف الطقس أو أسباب مشروعة أخرى ذلك.
2. الكابتن مسؤول دائماً وله سلطة صنع القرار النهائية. السلامة تأتي أولاً.
3. In the event of misconduct that endangers safety or property damage, the captain has the right to interrupt the voyage or end it immediately. According to Thai law, persons under the influence of alcohol/drugs must be denied access to the boat. In such a case, the customer's payment obligation remains.
4. Passengers must follow all crew instructions immediately and without delay. This also applies to putting on life jackets (nobody likes them, we know ... but as the law force us to do, we need to follow the rules). Beside of controlled areas by the Marine departement, wearing supplied live jackets is recommended at all time.
5. يمكن رفض الوصول إلى السفن والرصائف بدون سبب إذا اعتبره الطاقم ضرورياً، على سبيل المثال فيما يتعلق بالسعة أو السلامة أو النظام العام أو خطر إلحاق الضرر أو الإزعاج الوشيك.
6. يُتوقع من الراكب الاعتناء بالبيئة وعدم التخلص من النفايات في الماء. يجب التخلص من جميع الاستهلاك الشخصي والنفايات المرتبطة به في الحاويات المناسبة المتاحة على القارب.
7. Obvious errors and mistakes in the information provided, and/or published by Deep Blue will not bind Deep Blue. The Thai consumer law applies to these general terms and conditions. Disputes must be submitted to the competent court in the place where the consumer or passenger resides.

المسؤولية

1. Deep Blue غير مسؤولة عن تلف و/أو فقدان ممتلكات الركاب. يتحمل الركاب جميع متعلقاتهم على متن الطائرة على مسؤوليتهم الخاصة.
2. جميع الجولات المحجوزة مع Deep Blue مؤمنة ضد حوادث القوارب. بخلاف ذلك، Deep Blue غير مسؤولة عن أي إصابة شخصية أو تلف ممتلكات من أي نوع، بغض النظر عن السبب، قبل أو أثناء أو نتيجة للرحلة. لا ينطبق هذا على الضرر الناجم عن القصد أو الإهمال الجسيم من جانب Deep Blue. يقتصر التعويض القانوني على سعر إيجار القارب للرحلة المعنية.
3. لن تكون Deep Blue مسؤولة عن أي ضرر للأشخاص أو ممتلكات الركاب الناجم عن الدوس على رصيف أو قارب أو الصعود إليهما. يدخل الركاب هذه المناطق بالكامل على مسؤوليتهم الخاصة.
4. الضيوف مسؤولون عن أي ضرر يسببونه للعناصر/السلع المستخدمة من قبل Deep Blue أو أطراف ثالثة.
5. جميع الأنشطة على الشاطئ والماء التي تنظمها Deep Blue تتم على مسؤوليتك الخاصة.
6. الأطفال مسؤولية الوالدين. يُطلب من الأطفال دون سن 4 سنوات الجلوس على أحضان والديهم.
7. Should Deep Blue not be able to comply with their obligations due to force majeure, there is no entitlement to restitution or compensation, but refund of course.

 

الإيداع والدفع الكامل

بمجرد استلامنا إيداع بنسبة 50% على الأقل من السعر الإجمالي (شاملاً الضرائب) للعرض الذي وافقت عليه، يمكننا تأكيد الحجز.

The balance is due no later than 7 days before departure, in some cases 14 days before departure (depending on the logistics and the yacht). 
If you prefer to be on the safe side and pay the balance at boarding, please pay in cash in Thai Baht. Foreign currencies only by prior arrangement.  
 

الإلغاء من قبل Deep Blue (private-yacht.com)

• If it is not possible to safely complete the booked tour due to a technical problem or dangerous weather conditions (predicted by the Marine Department Thailand), we will offer you an alternative date or a full refund of all amounts paid.

الإلغاءات من قبل العميل

The purpose of the deposit is to ensure that both parties consider the booking to be binding.
Therefore, in the event of a unilateral termination of the contract (cancellation) by the customer, not in all cases a refund of the deposit is possible. This depends in particular on the booking lead times and the possibility of compensating for the loss through new bookings:

زورق سريع:

• الإلغاء حتى شهر واحد قبل المغادرة: استرجاع كامل *
• الإلغاء حتى 3 أيام قبل المغادرة: استرجاع 25% *

اليخت بمحرك / اليخت الشراعي / الكاتاماران بقوة:

• الإلغاء حتى 3 أشهر قبل المغادرة: استرجاع كامل *
• الإلغاء up to 1 month before departure: 25% refund *
  (less all payments for booked third-party services)

قارب الحفلات / اليخت الفاخر:

• عموماً، لا يمكن استرجاع المدفوعات لإيجار قارب الحفلات واليخت الفاخر، لأنه لا يمكن تعويض خسارة المبيعات خلال عدة أسابيع في ظل الظروف العادية.
• المدفوعات للخدمات المحجوزة من مزودي الخدمات الخارجيين**:
  • الإلغاء حتى 3 أشهر قبل المغادرة: استرجاع كامل
  • الإلغاء حتى شهر واحد قبل المغادرة: استرجاع 25%

تأمين الإلغاء السفري

نظراً لأن حالات القوة القاهرة الاستثنائية (تشمل هذه الأحداث، على سبيل المثال، المرض الشخصي أو الوباء أو إغلاق الحدود أو المطارات أو الحرب أو الشغب، إلخ) يمكن أن تجعل الإلغاء أمراً لا مفر منه، ولكنها لها نفس التأثير مثل الإلغاء العادي، ننصح بالحصول على تأمين إلغاء سفري. أو تحقق مما إذا كانت خدمات الطرف الثالث مغطاة بتأمين الإلغاء المضمن بالفعل في تذكرة رحلتك.

نظراً لأننا نصدر فواتير رسمية، فإن الاعتراف لم يكن مشكلة من قبل.
